These Terms & Conditions (“Terms”) govern your use of GenoByte’s genetic testing and related precision health services (“Services”).
By registering, submitting a sample, or accessing results, you acknowledge that you have read, understood, and agreed to these Terms.
2. Nature of Services
GenoByte provides genetic screening, wellness profiling, and precision health insights for informational and educational purposes.
Our services are not diagnostic and are not intended to replace professional medical advice, diagnosis, or treatment.
Clients are encouraged to consult licensed healthcare professionals before making any medical or lifestyle decisions based on GenoByte’s reports.
3. Client Eligibility
- You must be 18 years or older to register for the Services. Individuals below 18 years of age must be registered by a parent or legal guardian.
- If you are submitting a sample for another person (e.g., dependent or patient), you must have legal authority or consent to do so.
- By using the Services, you confirm that the information you provide is accurate, complete, and lawful.
4. Sample Collection and Processing
- You agree to follow GenoByte’s sample collection instructions carefully.
- Once your sample is received, it becomes the property of GenoByte for the purposes of processing, quality assurance, and anonymized research (if consented).
- Samples are processed in certified partner laboratories under strict quality and privacy standards.
- Samples may be stored securely for re-testing or quality validation for a defined retention period, after which they will be destroyed in compliance with regulatory guidelines.
5. Reporting and Interpretation
- GenoByte will provide a personalized genetic report accessible via secure digital platforms.
- Reports may include information on health risks, traits, carrier status, and drug responses.
- Genetic results are based on current scientific research and may evolve as new data becomes available. GenoByte reserves the right to update interpretations accordingly.
- Reports should be reviewed with a healthcare professional or genetic counselor for clinical context and personalized recommendations.
6. Data Privacy and Security
GenoByte is committed to protecting your privacy in accordance with the Personal Data Protection Act (PDPA) 2010 and applicable global standards (HIPAA, GDPR).
- Your identifiable data will not be shared with third parties without explicit consent.
- De-identified or aggregated data may be used for research, quality improvement, or product development.
- You have the right to access, correct, or request deletion of your personal data at any time by contacting GenoByte’s Data Protection Officer.
- All data is stored in secure, encrypted systems, with access restricted to authorized personnel only.
7. Consent for Genetic Testing
By submitting your sample, you provide informed consent for GenoByte to:
- Extract and analyze your DNA.
- Generate and deliver a genetic report based on the selected test.
- Use de-identified data for scientific and commercial research, if you opt in.
You may withdraw consent at any time, though this will not affect processing already completed.
8. Fees and Payment
- All payments must be made in full prior to processing.
- Fees are non-refundable once sample processing has commenced, except in cases of laboratory failure or administrative error.
- GenoByte reserves the right to adjust service pricing or packages with notice.
9. Limitations and Disclaimers
- GenoByte does not guarantee that your test results will identify all possible genetic risks or conditions.
- The accuracy of the results depends on sample quality and current genetic knowledge.
- GenoByte shall not be liable for indirect, incidental, or consequential damages resulting from use or interpretation of the reports.
- The Services are provided on an “as-is” basis without warranty of any kind.
10. Client Responsibilities
- Provide accurate personal and medical information.
- Use the report responsibly and consult qualified professionals before acting on insights.
- Maintain confidentiality of login credentials and avoid unauthorized sharing of reports.
11. Intellectual Property
All content, trademarks, and reports provided by GenoByte remain the intellectual property of GenoByte Sdn Bhd.
Clients may not reproduce, modify, or distribute GenoByte materials without written permission.
12. Research and Data Sharing (Optional)
If you opt-in, your anonymized genetic data may be used for:
- Scientific and medical research;
- Development of new health insights or products;
- Publication in aggregated, non-identifiable form.
Participation is voluntary and has no impact on your access to core services.
13. Service Modifications
GenoByte reserves the right to modify or suspend services for maintenance, updates, or policy compliance, with reasonable notice provided to clients where applicable.
14. Termination
GenoByte may suspend or terminate services if a client violates these Terms or engages in misuse of data or reports.
Clients may discontinue use of the Services at any time with written notice.
15. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Malaysia.
Any disputes shall be resolved under the exclusive jurisdiction of the courts of Malaysia.
